• Abbasi bəy indi qapalı məhkəmədə 2 dəfə mühakimə olunmuşdur, ki 5 Septambr 2006-da aparılan birinci iclasda vəkilin və valideynin bulunmalarına izin verilməmişdi, lakin 11 Septambr 2006-da aparılan ikinci iclasda vəkil bulunmağına imkan tapmışdı. Biz sizə daha çox bilgi təqdim etmirik, çünki Amnesty International tərəfindən buraxılan Təcili Aksiya sizə gərəkən bilgi qaynağıdır. Buna görə biz şikayətimizi bir daha ortaya qoyub və onu yenidən təkrar edirik. Biz bu işdə nə Abbasi bəy ilə məşvərət etmişik nə onun valideyni və nə də onun vəkili ilə. Ona qarşı məhkəmənin buraxacaq hökmü gələn həftə ərzində umulur və məhz buna görə biz sizdən xahiş edirik ki, bu şikayətimizə sürətlə baş qoşasınız ki, ta ki bu ədalətsizliyin qarşısı alınsın.

Re  AN UPDATE ON OUR COMPLAINT IN SUPPORT OF MR. RZA ABBASI 

We would like to provide you further update regarding our complaints on 5 September 2006 related to arbitrary detention of Mr. Rza Abbasi, deprived of his liberty by the authorities of the Islamic Republic of Iran. The new information is as follows:

• Amnesty International has now issued an Urgent Action recognizing him as a prisoner of consciences, see the link: http://web.amnesty.org/library/Index/ENGMDE131012006
• Mr. Abbasi has now been tried in a closed session court twice, disallowed the presence of his lawyer and parents in the first closed session on 5 September 2006 but his only lawyer was allowed in the second closed session trial 11 September 2006. The charges appearing to be “insulting the Leader” and “propaganda against the system.”

We are not providing you any further document, as the Urgent Action by Amnesty International and our previous letters provide you all the relevant information. However, we would like to add that the authorities acted in an obstructionist fashion for Mr. Abbasi’s first lawyer but his second lawyer (Mr. Khelili from Association of Defending the Rights of Prisoners) has some opportunity in attending the second trial. 

The fact is that Mr. Abbasi’s detention has been illegal in the first place and now the proceedings of his trial have also been conducted in an illegal fashion. We therefore wish to reiterate our complaint against the above irregularities, although we are not in any consultation with Mr. Abbasi, his family or with his lawyer in raising this complaint. The delivery of his sentence is expected to be next week and your speedy action can hopefully prevent a miscarriage of justice.

IRAN        Reza Abbasi (m), human rights defender

Human rights defender Reza Abbasi, a member of the Azeri Turkish minority in Iran (who sometimes refer to themselves as Iranian Azerbaijanis), has been detained in the city of Zenjan in northwestern Iran since 27 June, and is at risk of torture or ill-treatment. His trial, which does not appear to comply with international fair trial standards, is in progress. He may be a prisoner of conscience, detained solely on account of the peaceful exercise of his right to freedom of _expression, including his human rights work.

Reza Abbasi is a member of ASMEK (Association for the Defence of Azerbaijani Political Prisoners) and of the Alumni Association of Iran (Sazman-e Danesh Amukhtegan-e Iran-e Eslami [Advar-e Tahkim-e Vahdat]), an organization which has been active in promoting democracy and human rights. He was reportedly arrested on 27 June, after he refused to comply with a verbal summons to attend an Intelligence Ministry facility for interrogation. He is believed to be held in the Central Prison in Zenjan. According to reports, the Zenjan office of the Ministry of Intelligence has been harassing Reza Abbasi’s family, including by repeatedly summoning his elderly parents for interrogation.  

On 5 September, Reza Abbasi reportedly appeared before Branch One of the Revolutionary Court in Zenjan, in a closed session without the presence of his defence lawyer or his family.  A second closed session was held on 11 September, this time in the presence of his lawyer, who afterwards reportedly stated that Reza Abbasi had been questioned about his activities in various student organizations and for ASMEK.  The charges against him reportedly include “insulting the Leader [of the Islamic Republic of Iran] “ and “propaganda against the system”. The Court is expected to deliver its verdict during the next week.

Reza Abbasi's arrest followed widespread demonstrations in predominantly Azeri Turkish areas in May 2006 in protest at a cartoon published on 12 May by the state-owned daily newspaper Iran, which many Azeri Turks found offensive. The arrest was in advance of the annual Babek Castle gathering on 30 June, at which thousands of Azeri Turks gather to celebrate the birthday of Babek Khorramdin, who lived in the ninth century and is regarded as a hero by Iranian Azeri Turks. These gatherings have frequently met with repression on the part of the Iranian authorities, and this year the security forces were reported to have carried out arrests prior to the event, possibly to prevent certain people attending (for further information see AI Public Statement: http://web.amnesty.org/library/Index/ENGMDE130742006?open&of=ENG-IRN).  

BACKGROUND INFORMATION
Hundreds of people were reportedly arrested during or following the May 2006 demonstrations (see UA 151/06, MDE 13/055/2006, 26 May 2006 and UA 163/06, MDE 13/063/2006, 8 June 2006). Some of those detained have allegedly been tortured, with some requiring hospital treatment.  Publication of the newspaper was suspended on 23 May and the editor-in-chief and the cartoonist were arrested. Azeri sources have claimed that dozens were killed and hundreds injured by the security forces. The security forces have generally denied that anyone was killed, although on 29 May a police official acknowledged that four people had been killed and 43 injured in the town of Naqada.

ASMEK was reportedly founded in 2002.  Four of its founding members, including Reza Abbasi, are said to have been detained in April 2004 in connection with their activities.

RECOMMENDED ACTION: Please send appeals to arrive as quickly as possible, in Persian, Arabic, English, French or your own language:
- expressing concern that Reza Abbasi may have been detained solely in connection with his work as a human rights defender;
- calling on the authorities to ensure that he is not tortured or ill-treated, and to allow him immediate access to a lawyer of his own choosing, and to any medical treatment he may require;
- calling on the authorities to release him immediately and unconditionally unless he is to be promptly charged with a recognizably criminal offence and given a prompt and fair trial.
- asking the authorities for information about the reasons for his arrest, including any charges brought against him;
- expressing concern for the safety of his family, who have reportedly been harassed and intimidated by the authorities, and calling for them to be given all necessary protection to ensure their safety.

به گزارش روزنامه مردم نو آخرين جلسه دادگاه رضا عباسي فعال زنجاني صبح ديروز برگزار شد و وكيل وي به دفاع از متهم پرداخت.

خليلي كه پس از عدم پذيرش وكالت محمد علي دادخواه به عنوان وكيل مدافع عباسي از سوي انجمن دفاع از حقوق زندانيان به زنجان اعزام شده بود، به خبرنگار مردم نو گفت: با عباسي قبل از برگزاري دادگاه ملاقات دو ساعته اي داشتم كه روز قبل از آن نيز ضمن ديدار با وي، پرونده را مطالعه كرده و دفاعيه خود را مطرح نمودم كه در مجموع جو حاكم بر دادگاه در روز رسيدگي به پرونده مثبت بود.

وي همچنين صبح روز يكشنبه با مراجعه به قاضي، درخواست پذيرش قرار كفالت وي به مبلغ ۵۰ ميليون ريال را مطرح كرده بود و خواستار انتقال موكل خود از قسمت قرنطينه زندان به بند عمومي شده بود.

لازم به ذكر است رضا عباسي از فعالان حركت ملي آذربايجان در روز ششم تير ماه در آستانه مراسم سالانه قلعه بابك توسط ماموران اداره كل اطلاعات استان زنجان دستگير و هم اكنون با اتهامات تبليغ عليه نظام و توهين به رهبري روبرو است.

اولين جلسه دادگاه اين فعال زنجاني هفته گذشته در شعبه يك دادسراي انقلاب زنجان به صورت غير علني برگزار شد كه عباسي در اين جلسه درخواست داشتن وكيل براي خود را مطرح كرد.

Re    AN UPDATE ON THE CASE OF MR. RZA ABBASI

Please find attached information on Mr. Rza Abbasi’s trial (including further information on the outcome of few other trials). He is a journalist from Southern Azerbaijani city of Zenjan and now detained in the dungeons of the Iranian government. The trial was conducted in a closed-session after nearly three months of arbitrary detentions and torture in the dungeon and without bearing any guilt or without being acknowledged of any accusation. We mentioned his detention in our letters: Ref. 365/2006 on 19 August 2006 and Ref. 361/2006 on 12 August 2006 and provided you with further information in our letter Ref. 373/2006 on 31 August 2006.

We make no mistake by referring to you for our protection, as you are entrusted with the mandate by the world community to safeguard human rights. However, we are very concerned on your less verbal approach, as we keep presenting clear cases for your action in relation to the violation of human rights of Southern Azerbaijanis by the Islamic Republic of Iran in general and in relation to our prisoners of conscience in particular.

We are clear that the mandate entrusted on you is the key to constrain the excesses of rogue governments (such as Iran), and to maintain hope for the defenders of human rights (such as the Southern Azerbaijani prisoners of conscience). The world public opinion expects you not to be aligned with rogue governments (we believe this is not normally the case) but form a front against their violation of human rights (this is normally the case). In particular, the 50 million population of historic Azerbaijan is anxious to see that the High Commissioner on Human Rights is also safeguarding our human rights and we are eager to see this through evidence.

We kindly request you to apply your authority for the protection of Mr. Abbasi by dispatching your envoy to investigate Zenjan Prison, to monitor the court proceedings, to protest against the trials in closed-sessions and to take an uncompromising stance against trials without lawyers.

رسیدگی به پرونده رضا عباسی به صورت غیر علنی و بدون حضور وکیل و خانواده وی آغاز شد.

اولین جلسه محاکمه رضا عباسی فعال حرکت ملی آذربایجان در زنجان صبح امروز سیزدهم شهریور ماه در شعبه اول دادگاه انقلاب زنجان آغاز شد.روابط عمومی دادگستری زنجان در پایان جلسه دادگاه هیچ خبری از این محاکمه غیر علنی در اختیار خبرنگاران برخی نشریات استان که جویای وضعیت همکارشان بودند نگذاشت.دفتر شعبه اول دادگاه نیز  تمام سئوالات و پیگیریهای خانواده عباسی را بی پاسخ گذاشت.این دفتر حتی از اعلام نام قاضی پرونده نیز امتناع کرد.

امروز همزمان با جلسه دادگاه شماری از فعالان سیاسی ، اجتماعی و خبرنگاران استان زنجان در مقابل دادگستری منتظر بودند تا خبری از وضعیت رضا عباسی و پرونده وی بگیرند یا بتوانند او را ملاقات کنند اما این امکان نیز فراهم نشد.ایشان مقارن ظهر مطلع شدند که عباسی به زندان منتقل شده است.

با وجود اینکه ۷۰ روز از بازداشت رضا عباسی سپری شده است در تمام این او با هیچ وکیلی ملاقات نداشته است و اداره اطلاعات زنجان به خانواده وی هشدار داده است برای پیگیری پرونده او از وکیل استفاده نکنند.همچنین اطلاعات و مرجع قضایی هنوز از اعلام اتهامات عباسی به خانواده اش طفره می روند.

We have mentioned the case of Mr. Rza Abbasi in our previous letters, e.g. Ref. 365/2006 on 19 August 2006 and Ref. 361/2006 on 12 August 2006. He is a cofounder of ASMEK (The Committee for the Defence of Southern Azerbaijani Political Prisoners) and you are aware of their reputation as a bastion of human rights in Southern Azerbaijan.

Mr. Abbasi was arrested on 26 July in Zenjan and he is still in detention. This letter attaches the report on Mr. Abbasi produced by the Webblog Haq, and it provides you with further details. In the past month, the student societies in Zenjan and other cities have issued statements in support of Mr. Abbasi. He is now emerging as another case of perseverance against arbitrary acts of the Iranian authorities for simply promoting the Azerbaijani identity in our motherland and defending our human rights.

Arbitrary detention is obviously symptomatic of the Iranian way of governance but some of peculiar aspects of this case include:

1.      The so called the authorities are actively harassing Mr. Abbasi’s family members to get a forced confession

2.      They are intimidating Mr. Abbasi’s family for appointing a lawyer (this background has not been given in this letter but have been published)

3.      When the lawyer turned up in the court to take up the case, the prosecutor was reported to be on leave without a prior notice (as in Item 2 above).

We trust that you are monitoring the case and will support this prisoner of conscience soon.

بر اساس اخبار رسیده  اداره کل اطلاعات زنجان که از سپردن پرونده رضا عباسی به دادگاه امتناع می کرد نهایتا تسلیم مقاومت این زندانی شده و اجازه داده است پرونده وی روال قانونی خود را طی کند.رضا عباسی که از ششم تیرماه در بخش قرنطینه زندان مرکزی زنجان محبوس شده است به شدت برای نوشتن توبه نامه و تعهد عدم فعالیت تحت فشار بود.اداره اطلاعات برای نیل به مقصود خانواده او را نیز تحت فشار و بازجویی های مکرر قرار می داد و ایشان را وادار به سکوت و دعوت فرزندشان به نوشتن توبه نامه می کرد.عباسی با وجود شدت یافتن مرض قند پدر و فشارهای وارده بر خودش در قرنطینه در چند ملاقات خود با خانواده اش به صراحت گفته بود به خواسته اطلاعات گردن نمی نهم و اگر اصرار بر گرفتن امضا دارند من تمام آنچه را که در مورد عملکرد حکومت بیان کرده ام دوباره تایید و امضا می کنم.اما اکنون اداره اطلاعات و دادگاه انقلاب زنجان که حتی وکیل سرشناش عباسی ، محمد علی دادخواه را نیز به وکالت قبول نکردند دیروز اعلام کرده اند که آخرین جلسه بازپرسی او تمام شده و پرونده به دادگاه انقلاب رفته است.قاضی نقیلو مسئول رسیدگی به پرونده دیروز با اعلام این مطلب به خانواده عباسی درخواست فک قرار بازداشت عباسی را قبول نکرده و از احتمال تمدید قرار بازداشت خبر داده است.

بر اساس گزارش خبرنگار وبلاگ حق از زنجان، مقاومت رضا عباسی عضو موسس کمیته دفاع از زندانیان سیاسی آذربایجان(آسمک) که پیش از این یکبار هم در بهار سال ۱۳۸۳ دستگیر شده بوده موجب دلگرمی و تقویت روحیه فعالان هویت طلب و ملی در زنجان گشته و چندین مورد دیوار نویسی و پخش اعلامیه در حمایت از رضا عباسی در سطح شهر مشاهده شده است.
